Agape Furniture offers you, the user, all information, tools and services that are available within the website, all of these are conditioned upon your acceptance of all terms, conditions, policies and notices that are stated here.

Though visiting our website and/or purchasing something from us, you engage in our Service and are agreed to be bound to the following terms and conditions, included are these additional terms and conditions and policies that referenced with in this website and/or available by hyperlink. These Terms of Service apply to all users of the site, this includes users without limitation (browsers, vendors, customers, merchants, and/ or contributors of content etc.).

Before accessing or using our website, please read our Terms of Service carefully. By accessing or using any part of the site, you agree to be bound to these Terms of Service. If you do not agree to all our terms and conditions of this agreement, your access to our website or any of our services may be restricted. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

The rights to amend this website are reserved by Agape Furniture and in any conditions, you have no right to alter or modify any information that are provided on this website.

The information presented on the website is general information only. We will endeavour to ensure the update and precision of all information.

By using this website, you accept all the terms and conditions. If you do not accept you must stop using this website immediately.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction. You must not transmit any worms, viruses or any codes of destructive natures. A breach or violation of any of the Terms will result in an immediate termination of your Services.

2. GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

3. ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.

This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

4. Ordering

4.1 All goods are to be paid in full prior to pick up or delivery.
4.2 Upon completing an online order, you will receive an email with an order number and an order summary. A staff member will process your order within 24 hours and confirm the details in that order.
4.3 Lead times quoted are our best estimate based on the average time taken by previous orders. Occasionally, unforeseen delays occur as a result of raw materials being on back order. We will take all reasonable steps to make you aware of any such delay upon us being made aware of such a delay.
4.4 Payments can be made online by PayPal, Visa, or MasterCard, or Electronic Bank Transfer (Internet Banking). Any balances outstanding must be paid prior to delivery by Visa or MasterCard or Electronic Bank Transfer. Note: All transfers must be cleared prior to the order being picked up or delivered.
4.5 Orders ready for pickup or delivery will be stored for free for up to 14 days from the date we contact you, after which storage fees apply at the rate of $10 per seat per week. Storage fees will be debited against the deposit paid. If the deposit reaches nil or negative, we reserve to right to re-sell your order.
4.6 You have checked that the product is suitable for your needs, as we do not exchange.

4.7 Availability or In Stock indicates our current stock of that product in our warehouse (Strathfield South). Stock is allocated on a first come first served basis. Sometime physical stock may vary from available stock online, in case of no physical stock; AGAPE Furniture may refund your full deposit.

5. DELIVERY

5.1 It is important that someone is at home to receive the delivery of your purchase on the designated day. No specific time of delivery can be provided. A four hour time frame will be advised but cannot be guaranteed, we are not responsible for any delays. If no person is present to accept the goods on the scheduled delivery day, or the delivery is cancelled on the day of the scheduled delivery day, you will be charged for the non-delivery and a further charge for the re-delivery.
5.2 It is the customer’s responsibility to allow sufficient access for delivering the lounge.
5.3 Quoted delivery fee is for drop off to a ground level with sufficient access. Drivers do not unwrap items or take rubbish away unless specified.
5.4 All packing and wrapping materials are your responsibility and will be left at the premises (delivery address).
5.5 We make no representations about the Carrier other than those contained in this document, and we are not responsible for delivery by the Carrier. Any damage to property must be reported to the Carriers delivery driver as our company is not liable for any property damage caused by the Carrier.
5.6 Delivery timings can be after business hours as well from 6A.M till 10P.M (approx.). The quoted rates are for ground floor (EASY ACCESS), standard deliveries. A standard delivery is the product going through the ground floor, main front entrance of the home (EASY ACCESS).

5.7 For unpaid orders, someone must be available to accept, sign and pay for the order.

For fully paid orders someone must be available to receive and sign for the order, however if the order to be left.

Failing to receive the order after confirming the time frame will incur a re-delivery fee. The re-delivery fee will be calculated based on the suburb and will be advised prior to the re-delivery. A written confirmation is required to proceed with the re-delivery.

5.8 Sorry we are unable to move or dispose of old furniture.

6. PRICE AND PAYMENT

Price

• All prices listed on the Website are in Australian Dollars unless otherwise specified.

• Prices for our products are subject to change without notice.

• We shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

Payment

• We Require payment in full before the dispatch of Goods.

• We will contact you as soon as possible to advise you of your estimated delivery date and at this time the balance of any monies due will be payable. Only once we have received the balance of any monies due in cleared funds, will we be able to confirm your actual delivery date.

• Please note, we will not accept personal cheques or money orders on final payment.

Deposit

• For the preserved orders, we will keep the items for no more than 45 days(starting from the day we received the deposit). Within 45 days, please send us an email 3-5 business days before the delivery.
• Please note, AF will not keep the stocks over 45 days.

7. PRODUCTS AND SERVICES

Product specifications

• We are taking responsible steps to ensure the products delivered to you are in good conditions

• We will not be held responsible for any incident or consequential damages relating to the use or misuse of the products under any circumstances, being the vehicle, equipment, you or any third party involved.

• We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any colour will be accurate.
  Actual products may vary in colour and we advise you to visit our stores to view exact swatches.

• Leather Products are made from quality natural leather and accordingly, they may not be uniform in colour or texture. Only the finest hides are selected but they will show natural marks and scars on the hide. Some leathers will mellow with age and exposure to sunlight and heat.

• Please note that our lounge sets are made for a maximum individual weight of 110 kg of seating. No more than 25 kg of pressure weight should apply to the armrest

• Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

7.2 Service

We are committed to working through any issues you may have in accordance with our policies. Should any problems arise, please contact us and we will endeavour to assist. Our response time is up to 3 business days, or longer for weekends.

However, we reserve the right but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

Disclaimer of warranties; limitation of liability do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

   You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

   Under no circumstances will any of our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors from Agape Furniture be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel the quantities that are allowed to be purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting your e-mail, billing address or phone number that you provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
